Internal Rules and Regulations

DEFINITION OF TERMS

Member – a person who has concluded a written agreement with the Club regarding participation and the use of services, and who has undertaken obligations to comply with the Club's internal rules and other binding Club regulations.
Visitor / Client – a person who visits MARIENBADES GYM Fitness Center and is entitled to receive Club services in accordance with a concluded Agreement or on the basis of a paid one-time visit. This term includes both Members and persons with one-time or short-term/special access, and is used generally with regard to all service recipients.
Club – a sports and fitness establishment that provides Members and/or visitors with opportunities for physical activities, workouts, group classes, and related services, and establishes the rules and regulations for using these services.
Party / Parties – the Club or Member/Client.
Subscription – a type, duration, and price of the Club service usage opportunity, purchased according to the Club's price list and regulations, granting the Member the right to use the services within a specified time period or number of visits.
Visit – a single use of a Club service, such as an individual workout or a group class.
Card – a Member identification card issued by the Club, which, if issued, confirms the Member's right to use the services included in the Subscription. The card is valid only during the Subscription validity period.
Agreement – a mutual arrangement between the Member and the Club regarding the procedure for service use, rights, and obligations, executed in writing, the terms of which are binding on both parties.
Trainer – a certified person providing professional support during workouts, conducting classes, or offering individual consultations, working on behalf of the Club or as a Club cooperation partner.
Administration / Club Representative – a person representing the Club, ensuring order on the premises, providing information about services, monitoring contract fulfillment, and coordinating Member cooperation with the Club.
Force Majeure – circumstances, including but not limited to natural disasters, pandemics, war, technical failures, or other external factors that objectively prevent the Club from providing the service according to the Agreement.

RULES

1. Services offered at MARIENBADES GYM Fitness Club are available to all our club visitors – both club Members and persons using a one-time visit pass. All visitors must comply with the Club’s internal rules during their visit to the fitness center.

2. The Club has the right to change the Club’s working hours, price list, schedule, as well as other Club-related matters.

3. For service provision and safety purposes, the Club has the right to use special software features to store the personal data provided by clients.

4. For safety reasons, the Club is equipped with video surveillance and fire detection systems. During working hours, a Club administration representative is also on duty.

5. All Club visitors must maintain cleanliness, order, and politeness. Members must respect the peace and comfort of other Members while in the Club.

6. Club Members and visitors are required to handle the Club property with care (including issued Member cards) and use the equipment for its intended purpose. Visitors are strictly prohibited from throwing sports equipment on the floor.

7. Every visitor is responsible for their own workouts and health evaluation while in the Club. If any health issues arise during the visit, it is recommended to contact your physician. Visitors are required to notify the trainer and/or Club administration of any injuries or accidents immediately. In case of an injury, the Member must inform the trainer and Club no later than before the start of a workout or other service.

The Fitness Center does not guarantee emergency medical assistance for injuries or other health problems, but in such cases, the Club will take all possible actions to provide first aid to the affected person and, if necessary, immediately call the state emergency medical service.

8. Services, including training and consulting visitors, may only be provided by persons approved and/or employed by the Fitness Center administration. Visitors have no right to offer any of the above services to other club members without written permission from the Club administration. If a Member violates the requirements of this rule, MARIENBADES GYM has the right to unilaterally terminate the Member’s agreement and ban the client from visiting the Club.

9. The Club Member card (if issued) is personal and may not be transferred/gifted to another person. If the Member violates this rule, the Club has the right to cancel the Member card.

10. A Club administration employee has the right to request Fitness Center visitors to present the Member card and/or identification documents. In such cases, the visitor is obliged to provide a valid personal identification document.

11. The Member must immediately notify the Club administration if the Member card is lost. An additional fee for card replacement may apply, as listed in the service price list.

12. Lockers in the Fitness Club are locked with keys. Keys are issued individually before receiving the service. A person who receives a locker key from an administration employee must return the key to the administration after using the service. If the key is lost during the use of services, a compensation fee may apply according to the service price list.

13. For safety and hygiene reasons, visitors must wear sports-appropriate clothing and shoes in the Club premises. Sandals or other types of shoes, or being barefoot, are not allowed in the sports hall. In shower areas, slippers are recommended. Only indoor change shoes and clothing not worn outside are allowed on Club premises.

14. Smoking, bringing and/or consuming alcoholic beverages, and being under the influence of intoxicating substances is strictly prohibited in the Club and on its premises.

15. Eating any type of personal food is prohibited in the Club premises.

16. Club services are available to persons over 12 years of age and only under the supervision of a responsible adult or, in exceptional cases, under a trainer's supervision. MARIENBADES GYM membership agreements are signed with persons from 16 years of age. The agreement with a minor must be signed by their legal guardian or parent. It is prohibited to bring and/or leave persons under 12 years of age in the Club premises without supervision.

17. During classes, towels must be used. Towels can be rented at the Club reception at the price listed in the service price list before using the service.

18. To maintain order, visitors are required to return sports equipment to its designated place after use. The screws of the seat and handle adjustment of exercise bikes must be loosened and the seat cleaned. Treadmills must be returned to the start (default) position after each use. All training equipment must be cleaned with the designated disinfectant after use.

19. Group class reservations can be made personally by registering with group class leaders/trainers or at the Club reception.

20. It is prohibited to be late for group classes. Incomplete warm-up exercises increase the risk of injury. If a visitor is late, the Club has the right to give the reserved spot to another visitor. The trainer has the right not to allow a visitor who is late to join the class, even if a spot is reserved.

21. If a visitor must leave a group class early due to extraordinary circumstances, the trainer should be informed before the class begins.

22. If theft committed by a Club visitor is detected, a lifetime ban from visiting the Club comes into effect immediately. In this case, money paid for the time period or purchased Subscriptions is non-refundable. The Club has the right to claim compensation for losses resulting from theft.

23. Lockers in changing rooms are only for use during Club operating hours and during a visit. Leaving personal belongings outside visiting hours or outside Club operating hours is prohibited. The Club ensures that all lockers are cleared of abandoned items daily after closing.

24. When leaving, visitors must return the locker key to the administration.

25. Lost and found items in the Club are stored at the reception for 14 days. Clients can claim lost and found items at the reception according to Club working hours.

26. Visitors must leave the Club and its premises before closing according to the schedule.

27. Only Club-provided disinfectants may be used in the Club premises, which are the property of the Fitness Club.

28. Payments can only be made in cash or via bank transfer.

29. Towels must be used while sitting in the sauna. Shaving, hair coloring, drying laundry, and other inappropriate or prohibited activities are forbidden in Club premises.

30. The use of oils, honey, and other body or facial care products is not allowed in sauna and shower areas. Pouring water on sauna stones is prohibited.

31. Photography and filming in the Club (including changing rooms) is allowed only for personal purposes. Photography and filming for other purposes must be pre-approved by the Club administration at the reception or via email at administration@mygym.lv. Visitors must ensure that no other persons appear in photos or videos without their written consent.

32. In case of rule violations, the administration has the right to ask the visitor to leave the Club premises, impose a fine of one hundred (100) EUR, deny access for a certain period, or unilaterally terminate the concluded agreement. In this case, money for subscriptions or visits will not be refunded.

33. The Club has the right to demand full compensation from the visitor for direct material damages caused by the visitor’s actions or negligence, including damaged equipment, premises, or other Club property. Compensation is determined according to actual damages.

34. The Club is not responsible for clients’ personal belongings. Valuable items should be stored in the place designated by the Club administration. The Club is not responsible for items stored in the location designated by the administration.

35. The Club is not responsible for deterioration of health, illnesses, injuries, or other accidents resulting from the client’s own actions.

36. Visitors not registered for group classes may not interfere with the class in any way or use equipment designated for the class.

37. Visitors not participating in individual training with a certified Club trainer may not use equipment designated for that training, interfere with the training, or enter areas reserved for the trainer and/or their client.

38. The Club administration has the right to make immediate decisions in emergencies and critical situations to ensure the safety of visitors, staff, and Club property.

39. If any physical conflicts, aggressive behavior, threats, or other prohibited activities occur on Club premises, the Club administration has the right and obligation to immediately: restrict or deny further access to persons violating the rules; document the incident on video or in writing if necessary; call the State Police or other relevant authorities if required.

40. The Club is not responsible for limitations or interruptions in service availability caused by force majeure, such as natural disasters, technical failures, pandemics, or other external factors.

41. The Club has the right to perform cleaning, maintenance, and equipment repair works, trying to minimize inconvenience to clients. The client agrees not to raise claims or demands regarding possible inconveniences caused by these works, including temporary unavailability of Club services.

42. The Club has the right to use Club premises to organize events. Temporary changes to working hours and/or restricted use of the Club are possible. The Club notifies clients in advance about events by posting information on the Club website www.mygym.lv. The client agrees not to make claims regarding possible inconvenience caused by temporary unavailability of Club services.

43. Notices and correspondence are considered delivered to the client if five (5) business days have passed since sending.

44. The Club publishes general information on its website (www.mygym.lv).

45. The Club has the right to disregard requests for contract termination, changes, or training leave if requests are not properly submitted.

46. The client agrees to immediately notify the Club of changes to personal and contact details.

47. Matters not regulated in the Agreement are governed by the applicable laws of the Republic of Latvia.

48. All disputes arising from or related to the Agreement are resolved through negotiations, but if no agreement is reached, disputes are resolved in court according to the laws of the Republic of Latvia.

49. Unless stated otherwise in the Agreement, the Parties do not disclose information about the conclusion of the Agreement or its terms to third parties.

50. The Club processes Members’ personal data in accordance with the General Data Protection Regulation (GDPR) and other applicable laws and requirements, and in accordance with the terms set out in the Club’s Privacy Policy.

51. The Club has the right to organize campaigns, during which granted benefits are valid only for the specified period and only for persons meeting the criteria stated in the campaign rules.

52. Clients are prohibited from sharing, transferring, or otherwise making available to third parties any information about other Club visitors, Members, or Club personnel. This prohibition applies to verbal, written, visual, and digital information, including photographs, videos, and other materials, regardless of how obtained. Unauthorized disclosure without written permission from the Club administration is considered a serious breach of rules and may result in unilateral contract termination, access revocation, and other actions according to Latvian law.

53. The Club is responsible to the client. The client may seek legal remedies against the Club only if the Club has intentionally breached its obligations or acted with gross negligence. Liability limitations do not apply in cases of fatal incidents or harm to health.

54. The Club’s internal rules and Privacy Policy are drafted and available in three languages. Texts in other languages are for informational purposes. In case of dispute, the Latvian text applies.

At MARIENBADES GYM Fitness Club (“the Club”, “we”, “us”, “our”), we respect and protect the privacy of all website visitors, members, and clients (“you”, “your”). This Privacy Policy explains how we collect, process, store, and safeguard your personal data in accordance with the EU General Data Protection Regulation (GDPR), the Latvian Personal Data Protection Law, and other applicable regulations.

By submitting your personal data through our website, signing up for services, or using our facilities, you acknowledge that you have read, understood, and accepted this Privacy Policy.

Once no longer required, data will be securely deleted or anonymized.

5. Data Sharing and Third Parties
We do not sell or disclose personal data for marketing purposes. Data may be shared with:
- Authorized Club employees with limited access
- IT service providers supporting our website or email systems
- Government authorities if required by law
All third parties are contractually required to comply with GDPR and protect personal data.

6. Security Measures
We implement measures to protect your data, including:
- Encrypted data transmission (SSL/TLS)
- Controlled access to databases
- Regular IT security monitoring
- Staff training and confidentiality obligations

7. Cookies and Website Tracking
Our website does not use tracking, advertising, or analytics cookies. Only essential technical cookies are used for website functionality.

8. Your Rights as a Data Subject

11. Minors
We do not knowingly collect personal data from minors under 14 via our website. Individuals aged 14–16 require parental or guardian consent.

12. Updates to Privacy Policy
This Privacy Policy may be updated to reflect legal or operational changes. The latest version is always available on our website.
